CALL FOR CONSULTANCY

Terre des hommes Foundation Mission in Kosovo, is seeking to contract a Team of Experts/Company on drafting sub legal-act on - The minimum age for the child’s employment/Preventing and Prohibiting Dangerous Forms of Child Labor.

BACKGROUND INFORMATION ON TERRE DES HOMMES MISSION IN KOSOVO:

Terre des hommes in Kosovo has been operating for over 15 years in the field of child rights and child protection, leading the establishment and strengthening of a national child protection system in the country. While working with several partners at the national and local level to ensure qualitative child protective services and promoting social inclusion of the most vulnerable communities. Terre des hommes’ area of expertise ranges from direct psycho-social interventions with vulnerable children and their family and community members, to empowerment of local, regional and national level governmental institutions and key stakeholders through capacity-building and on-the-job training in order to develop and implement proper child-sensitive structures, policies, standards and procedures.

PROJECT GENERAL INFORMATION:

Terre des homes in Kosovo is implementing the project Child Protection Safety Net (phase 3) funded by Medicor Foundation during January 2017 – December 2019 (3 years), covering all municipalities of Kosovo. Terre des hommes will continue its presence in Kosovo and assist local authorities in building an effective child protection system. The main focus of this project is: to help the implementation of the new Law on Child Protection, to develop secondary legislation, to provide the necessary technical expertise, to develop new specialized services and to build the infrastructure for monitoring and accountability mechanisms.

In the framework of the project, under the objective 1 support local actors in implementing the new Law on Child Protection with the output on development of sub-legal acts and based on the experience with the development of the model of specialized services for children living or working on the street, emergency services for children who are found at high risk and need immediate sheltering, specialized services for children victims of sexual abuse. Terre des hommes Tdh in close cooperation with the respective Ministry of Labor and Social Welfare and relevant expert will draft sub-legal act on Child Protection Houses based on the Law on Child Protection under the article 50 paragraph 6.

OBJECTIVE OF THE SERVICE:

Sub-legal act on the minimum age for the child’s employment/Preventing and Prohibiting Dangerous Forms of Child Labor. Law on Child Protection under the article 50, according to this, minimum age for the child’s employment will be defined by law, taking into account the time required for the child to achieve the appropriate physical and mental maturity and to complete basic education. It is forbidden to engage a child under the minimum age for employment in any paid or non-paid employment relationship.

The child can only be employed in economic activities that are not harmful to the development and health of the child, especially when they do not prevent them from attending school and use of leisure time, and if such labor is not prohibited by the legislation in force. The labor that is part of the professional practice and under the respective supervision, after all risks have been identified and eliminated, is also allowed.

In regards to the payment of contributions and other legal obligations, the employer shall be obliged to register the employed child in the Tax Administration of Kosovo, and other institutions that manage and administer mandatory pension schemes and others.

Preventing and Prohibiting Dangerous Forms of Child Labor in Kosovo shall regulated by an administrative instruction issued by the Government upon proposal by the relevant Ministry of Labor and Social Welfare.

DUTIES AND RESPONSIBILITIES:

The duties of the Team of Experts/Company will include, but not limited to:

  • Undertake comparative analyses of the EU and ILO standards, national legislation and best practices applied in the region and wider on related and similar policy solutions, procedures and practices, to inform the draft sub-legal act.
  • Gather information from CSW/Social workers, Ministry of Justice, Ministry of Labour and Social Welfare, Office of Good Governance, local and international practitioners and experts as well as all other stakeholders (International/local NGO’s) Provide on current practices and related processes.
  • Undertake desk legal framework review.
  • the first draft of the sublegal act on The minimum age for the child’s employment/Preventing and Prohibiting Dangerous Forms of Child Labor as per the article 50, para 6 of the Law No. 06/L-84 on Child Protection and in compliance with all existing legislation and related conventions;
  • Submit the draft to the formally established working group to use as bases for discussion during the process of development of the Sub-legal act.
  • Engage fully and proactively in cooperation with the working group established as per the decision issued by respective Ministry;
  • Support the Working Group chair in facilitating two (2) consultation workshops on the above mentioned sublegal act.
  • Reflect the consultation with key stakeholders and the public in the content of the sublegal act.
  • Maintain a neutral and professional approach during the whole process.
  • The team of experts/company will conduct its duties respecting Tdh charter and Tdh Child Protection Policy
  • Submit sublegal act on a timely manner.

TIMEFRAME:

The task is foreseen to be completed in up to twenty (20) man/days within the period between November 2019 – March 2020.

Support the Working Group chair in facilitating two (2) consultation workshops on the above mentioned sublegal act.

Reflect the consultation with key stakeholders and the public in the content of the sublegal act.

These arrangements of days and dates are a subject to mutual agreement between the representative and/or team of experts’ leader/company and Tdh.

REQUIRED SKILLS AND EXPERIENCE:

  • Expertise and experience in Law with legalist human rights, child rights and justice background;
  • Expertise and experience in social services/child protection systems and previous experience drafting sublegal acts and designing new policies.
  • Expertise and experience in researching and track record of similar expertise national and international level
  • Working experience with the government institutions in field of revising existing documents
  • Experienced in inter-sectorial working approach
  • Knowledge related to specifics and nature of child abuse, discrimination, risk & vulnerability, case management
  • Keen attention to details is necessary in order to analyze and revise documents
  • Ability to understand the specifics of the project to make intelligent decisions regarding the production of documents

SELECTION CRITERIA:

  • Relevant Experience - team leader: 40%
  • Proposed methodology: 30 %
  • Proposed experience /skill mix: 20%
  • Financial offer: 10%
