CALL FOR CONSULTANCY

Team of Experts/Company on drafting sub legal-act on Instruction for measures of identification, reporting, referral and investigation of violence, neglecting and abuse of children

Terre des hommes Foundation Mission in Kosovo, is seeking to contract a Team of Experts/Company on drafting sub legal-act on Instruction for measures of identification, reporting, referral and investigation of violence, neglecting and abuse of children.

BACKGROUND INFORMATION ON TERRE DES HOMMES MISSION IN KOSOVO:

Terre des hommes in Kosovo has been operating for over 15 years in the field of child rights and child protection, leading the establishment and strengthening of a national child protection system in the country. While working with several partners at the national and local level to ensure qualitative child protective services and promoting social inclusion of the most vulnerable communities. Terre des hommes’ area of expertise ranges from direct psycho-social interventions with vulnerable children and their family and community members, to empowerment of local, regional and national level governmental institutions and key stakeholders through capacity-building and on-the-job training in order to develop and implement proper child-sensitive structures, policies, standards and procedures.

PROJECT GENERAL INFORMATION:

Terre des homes in Kosovo is implementing the project ``Social inclusion and improvement of living conditions for Roma, Ashkali and Egyptians and other vulnerable groups in Kosovo`` in partnership with the organization Voice of Roma, Ashkali and Egyptian communities (VoRAE). Regarding the activity, draft law on child protection offers the basis for the institutionalization of case management round table system, in the second phase of the project, efforts will concentrate on providing technical assistance to relevant authorities, ensuring the functionality of Case Management Roundtables, improving the quality of services provided, increasing the capacities of child protection professionals in case-management, and consolidating the multi-agency response of child protective structures..  Terre des hommes will continue its presence in Kosovo and assist local authorities in building an effective child protection system.

At the root of this situation is the absence of an adequate strategy and law for child protection by the Government of Kosovo. Institutionalized and coordinated mechanisms of prevention and protection against child abuse, neglect, violence and trafficking do not exist. The gap between international obligations (such as the UN Child Rights Convention and EU integration principles), national laws and policies on one hand, and their implementation on the other, remains large.

The overall project goal: Social inclusion of Roma, Ashkali and Egyptians in Kosovo is improved through institutionalized afterschool support programs and an improved child protection system, as well as through enhanced capacities of governmental institutions and local civil society to develop and implement successful models for social inclusion as part of the National Roma, Ashkali and Egyptian Inclusion Strategy and Action Plan.

The main focus of this project relevant to the assignment is: to develop secondary legislation, to provide the necessary technical expertise, to draft 3 sub-legal acts on standards for child protection, referral and complaint mechanisms are developed by the Office for Good Governance, Ministry of Labor and Social Welfare, Ministry of Interior and Ombudsperson.

In the framework of the project, Tdh in cooperation with Defence for Children – ECPAT the Netherlands, supported by Dutch Ministry of Foreign Affairs collaborated with the aim of assisting professionals in the field of Child Protection. Thus, in order to contribute to the efficacy of all agencies working in the field of child protection by explaining the responsibilities for respective agencies and actions which should be taken in order to act in the best interest of the child was developed the Working Protocol.

OBJECTIVE OF THE SERVICE:

Sub-legal act on Instruction for measures of identification, reporting, referral and investigation of violence, neglecting and abuse of children; Upon proposal of the relevant Ministry for internal affairs and relevant Ministry of social welfare, the Government issues the administrative instruction which includes but is not limited to effective sub-procedures for identification, reporting, referral and investigation of violence, exploitation, neglecting and abuse of the child, the appropriate and preventive measures for presence of child in public locations, protection of child on street condition.

Given that the draft law on child protection offers the basis for the institutionalization of case management round table system, in the second phase of the project, efforts will concentrate on providing technical assistance to relevant authorities, ensuring the functionality of CMRs, improving the quality of services provided, increasing the capacities of child protection professionals in case-management, and consolidating the multi-agency response of child protective structures. One of the first tasks of the project in this direction will be to support the drafting of the sub-legal acts of the child protection law and submit it to the legal office of the Prime Minister. This will be complemented by technical support through coaching and mentoring of the social workers. It is hypothesized that the working methods, techniques and instruments provided through training will improve the capacity of professionals to deliver quality services thorough this child protection mechanism.

DUTIES AND RESPONSIBILITIES:

The duties of the Team of Experts/Company will include, but not limited to:

  • Undertake comparative analyses of the international standards, national legislation and best practices applied in the region and wider on related and similar policy solutions, procedures and practices, to inform the draft sub-legal act.
  • Gather information from CSW/Social workers, Ministry of Justice, Ministry of Labour and Social Welfare, Office of Good Governance, local and international practitioners and experts as well as all other stakeholders (International/local NGO’s) Provide on current practices and related processes.
  • Undertake desk legal framework review.
  • The first draft of the sublegal act on Instruction for measures of identification, reporting, referral and investigation of violence, neglecting and abuse of children as per the article 26, para 6 pf the Law No. 06/L-84 on Child Protection and in compliance with all existing legislation and related conventions;
  • Submit the draft to the formally established working group to use as bases for discussion during the process of development of the Sub-legal act.
  • Engage fully and proactively in cooperation with the working group established as per the decision issued by respective Ministry;
  • Support the Working Group chair in facilitating two (2) consultation workshops on the above mentioned sublegal act.
  • Reflect the consultation with key stakeholders and the public in the content of the sublegal act.
  • Maintain a neutral and professional approach during the whole process.
  • The team of experts/company will conduct its duties respecting Tdh charter and Tdh Child Protection Policy
  • Submit sublegal act on a timely manner.

TIMEFRAME:

The task is foreseen to be completed in up to twenty (20) man/days within the period between November 2019 – March 2020.

These arrangements of days and dates are a subject to mutual agreement between the representative and/or team of experts’ leader/company and Tdh.

REQUIRED SKILLS AND EXPERIENCE:

  • Expertise and experience in Law with legalist human rights, child rights and justice background;
  • Expertise and experience in social services/child protection systems and previous experience drafting sublegal acts and designing new policies.
  • Expertise and experience in researching and track record of similar expertise national and international level
  • Working experience with the government institutions in field of revising existing documents
  • Experienced in inter-sectorial working approach
  • Knowledge related to specifics and nature of child abuse, discrimination, risk & vulnerability, case management
  • Keen attention to details is necessary in order to analyze and revise documents
  • Ability to understand the specifics of the project to make intelligent decisions regarding the production of documents
  • Team-oriented / ability to work and cooperate with actors part of the document.

SELECTION CRITERIA:

  • Relevant Experience - team leader: 40%
